The victim reported the alleged rape to law enforcement June 14 after being examined at Salem Memorial District Hospital, according to the case’s probable cause report. She said Smith forced himself on her against her wishes at a residence in Salem. She said she then escaped from Smith to a bathroom, from where she called for help. A friend of the victim responded and removed Smith from the residence, according to the report.
The report states during an interview with officers Smith said he was intoxicated June 14 and didn’t clearly remember the events which transpired. He said he did believe he had the victim’s consent for any sexual activity.
